Refund of tenant/buyer deposits for rent-to-own

    I have been getting some mixed information regarding tenant/buyer deposits for rent-to-own contracts. In the case that a tenant/buyer doesn't close on the contract, is the deposit non refundable?
    I have been informed that it is 100% non-refundable, a "reasonable portion" is refundable, and that it is 100% refundable.
    I am aware that we are trying to "forward think" on what the CMHC requirements will be in the future when the contract closes but I am curious if anyone can provide some additional insight?
