rental application forms

we are looking to place a tenant ourselves. in the past they have all had property management. note on the rental application forms they include drivers licence s.i.n. birthdate bank and bank acct number are these permitted to be asked and are they necessary do you first fil out the rental application forms and if qualified a lease later thanks ken

You need most of that information in order to do a credit check and a criminal background check. Some tenants balk at giving up this info so it can be helpful to explain why you need it in advance.

Whatever form you use, make sure that it conforms to the province in which you are renting.

You can check this out by reviewing the local (provincial) government regulatory board.

If a prospective tenant asks why you need their SIN, you don`t. Credit and/or rental forms that ask for a SIN should indicate that this information is optional. Credit checks can be done without it though the credit bureaus like it because it is the only reliable unique ID number for all Canadians. Social Insurance Numbers are only legally required for transactions involving the Federal Government.

We have come to use the Calgary Apartment Association lease and move-in/out forms. Tenants generally trust a document that is produced by such a group. And they come as `NCR` paper with 3 copies, so no photocopying or multiple signatures required.

Most cities in Canada will have a similar association and they generally all belong to the national association.

You are allowed to ask for SIN and Driver`s License. In accordance to the Law and as far as the Office of the Privacy Commissioner of Canada, there is no legislation that prohibits organizations from asking for it. However, people are becoming more saavy and asking why (which is anyone`s right to do and what purpose) because unfortunately there`s so much fraud being committed and legally, yes they can refuse.

OFF TOPIC but similarly related on the ID front...., (in case you didn`t know)...now as a REALTOR, we now have to ask everyone for proof of ID whether buying or selling. Reason being, there are specific regulations for the real estate sector imposed now for anti-money laundering and anti-terrorist financing took effect on June 23rd, 2008.
