I rent, and the house next door is currently for sale.
Previously, the owner had an Airbnb and was using pictures of our waterfront on her listing. The other house IS waterfront, it just has never been maintained and reeds block access to their waterfront. Our house is adjacent with no fence. Our property has a private dock and a mowed waterfront area.
We have kicked multiple Airbnb guests off our property, and asked that the Airbnb ad remove our waterfront from her listing to stop this trespassing.
Now she had decided to sell, and is using the same photographs as her Airbnb ad of our waterfront and our property.
Is this legal? They were clearly on our property (without permission) when they took the photos, and she is marketing our waterfront as part of the property she is selling. Can we legally ask her to take them down? How should we go about it? Direct conversation/reaching out isn't working.
Thanks for your help,
C

Can they: yes. They did. Is it legal: probably not. Is it misleading: yes. What is your damage?

What can you do?

1) You can phone or email realtor politely.

2) Or you can go to court.

3) Or you can ask the RE council (RECBC in B.C., RECA in AB etc ) to investigate.

4) Or you can contact the realtor and threaten to take her to the RE Council. That fourth option will likely do the trick.
