My current tenant, hotel development manager, would like to move out but leave all contents to next tenant who is a seperate company but will manage the hotel. My problem is with the move out process/new lease agreement. If he doesn't move out how am I able to assess damage deposit. Both tenants(current and future) are willling for the future tenant to have existing damage deposit transferred to new tenant and responsibility for present and future damages reside with the new tenant. Would this work if properly documented? Suggestions on handling this situation without a complete move out by the existing tenant just to move back in.
