okay im going to try and get the most of the story here.
I was renting a place a while ago right by SAIT. awesome place that didnt charge to much. When I had to move I wanted to hold on to it. Realizing rent was so cheap, I decided to partly furnish it and charge more. On top of that, some of the repairs I did myself as the management company is not that great.
anyways, I rented it out for $600 a bedroom ($1200 in total).
I have been doing this for the last 3 years and the last year a girl was staying here. We didn`t have a lease in place. She just had me sign a piece of paper saying she could stay there for atleast 6 months. She found a friend to be a roomate and each of them payed me with seperate cheques.
On December 31, I sent a letter saying I need a lease signed by Feb 1 or they would need to move.
Her roommates decided to move and she told me she wanted to stay. So I went to work trying to find her a roommate. Now, with only 1 week left in Janauary, she tells me she is leaving for feb 1 and wants her damage deposit back.
I told her I need a month notice or I cannot give it back.
She told me that charging above the rent im paying in the sub-lease is illegal and that because of my letter, she has the right to leave any time she wants before feb 1.
From what I know, its not illegal to charge more for a sublet. Can anyone help me here? She saying if i dont give her back her DD, she will file a compaint to have my pay her back all the profit from the last year of rent?
my understanding is technically, she is only paying $600 which is under rent. And even with a letter, she still needs a month notice.
Can someone help quick! Feb 1 is coming!
