tenant eviction problem

Hi,

I have zoning rental house located at York University Village in toronto, most of tenants are students from the university. At the beginning of the this year, I mistakenly leased the basement three units to one family of three members (mom and two sons). Since March, the problems came out. Two sons always fight each other, screaming, and smoking marijana (they admited it to me), three students have left the house because of fear. The worst of all is they never pay the rent on time, so far they own me rent of two months ($2100), plus no deposit for last month ($1100).

I gave them formal notices three time since April, but they kept telling me they didn`t find the house because of lack of money. This month I paid them $900 for them to find the house (I am stupid, right? I am desperate!!), and let them sign the termination of tenancy form N9, both of three members signed. but upto day, there is no sign of leaving.

I have given them three notices, and they also signed tenancy termination form, what else I can do if they still stay?

would you please help me here, I am desperately for the help. Thanks in advance!!

You need to hire a paralegal and go through the legal process of eviction. I`m not sure which forms you gave them if they are not the proper legal forms from the Landlord & Tenant Board you will have to start over. Bring all the forms you have to your paralegal pronto. You can do this process yourself but at least the first few times you do it(until you know more and feel comfortable) I cannot stress enough how important it is to do it properly. So hire someone who is familiar with the law.

The troubled tenants have signed legal form N9 from the Landlord & Tenant Board in Ontario. is it right form? I saw someone signed N11. looks they are same, both is the tenancy termination form signed from tenants.

It looks like you can just file a L3 application if the tenant signed the N-9. What is the termination date on the notice. You have 30 days from the termination date to file the L-3. According to the instructions you will then receive the order in the mail which you can then use to apply for the sheriff.

In the future you may want to use the standard N-4 as soon as the tenant is late with the rent. This will give you an eviction based on non-payment.

Hopefully things go smoothly...you can fill out the form yourself and put it in with the Board if you have any problems though with the tenants contesting it then paralegal right away!

N4 on the second day of the month. It`s a key part of the foundation for successful landlording in Ontario.
