Tenants gave notice Nov.3

Hello All. A tenant of mine just gave notice yesterday, November 3, and informed me they`d be moving out "sometime" on December 1. Although their notice was only two days late, would you handle the situation differently? And what day and time does the tenant actually have to be out of the property?

What provience are you in? If you have a lease the move out time should be on it. In Alberta the move out time is 12 noon the last day of the month. The notice must be given on or before the first day of the month. Check with your landloard and tennent association.

month to month leases must be canceled ONE month prior (assuming it is AB), i.e. the 1st (not 3rd) .. so on Dec 1 you should ask for a full December rent .. or at the very least keep their damage deposit. Get ready to find new tenants, as they will likely not pay you for December.

have they been good tenants? How would you proceed if they told you 2 days earlier? you would have probably advertised the apt for rent and started finding new tenants. What happenend in those 2 days to change your ability to find new tenants? probably nothing. You can dig in your heels and fight them and try and get dec rent from them and they can get mad and trash the place. Or you can work with what they`ve given you which is really only 2 less days, start advertising, showing and get in new tenants. Explain to them that they did not give you sufficient notice but you will work with them in letting them out of their commitment by dec 1 if they work with you ensuring that the place is clean and tidy for the showings and that if you are able to find a suitable tenant for dec 1, they will no longer be responsible for that month`s rent.
