I have a tenant that has been great for the last 3 years until recently he has not paid his Sept rent. We are now 26 days into the month and he still has not paid. He has some personal issues going on however indicates that he is financially fine. He says he mailed the cheques but I have not received them and now he says he need to contact the bank to "find them". I told him to just cancel the cheques and deposit the Sept rent. so I am waiting until tomorrow.
Am I being naive to believe he will pay?
What are my next steps?
I live in a different province from where my rental property is and I just got rid of the property mgmt company I was dealing with. All bad timing I know! I`m at a loss and would appreciate some advice.
On Sept 2nd you should have sent your tenant a N4. Do it immediately.
You are unlikely to see another dime from this tenant and you should immediately begin the process to evict via the N4.
At this point in time you should demand a cashiers check or cash from this tenant. Since you are out of provence have him do a wire transfer.
His lost check, which he actually likely did not send, is not your problem. He is stalling.
You really need someone locally to handle this situation as I firmly believe you are not going to see any more rent from him.
Since the eviction process can take months every day wasted is going to cost you more money.
You may still see the money. I was surprised this Friday when I got 2 months or rent from a tenant after having her served with a date to appear before the tribunal. She wants to stay until Christmas after which time I will probably be in a battle again.
What city is your property in. There may be a la carte property managers in the town willing to take on the N4 process and appear before the tribunal on your behalf without needing to hire them full time.
Totally agree with Greg `invst4profit`. Please assume you are not going to see a cent from this person and just start the process to end his tenancy. Mail N4 tomorrow.
AFTER sending him N4, call to say unfortunately you had to do that, and tell him he can stop the process if he deposits the amount to your bank account by Tuesday.
Do not even mention the check he "sent" as he knows he didn`t and even if he did he would know you are not going to deposit it.

Sorry I don't know any property managers in the Ottawa area. Maybe another member can make a recommendation.
You can mail in the N4 but then you will need to add a couple more days to your final deadline before setting a date to take them to the tribunal. The link to getting the forms and some good explanations are shown below:
I don't think a PM can do that any longer re not be hired as the pm just for ltb... I think that would require a paralegal or lawyer

It is my understanding you can hire a PM to go to the board on your behalf but the landlord needs to be there which is not possible in this case as the landlord is from out of province, or as you suggest the PM would also need to go with a paralegal. This is the way my Brantford PM handles it when I hire him to just do the job of evicting tenants. It may be time to start hiring a full time property manager for some of my properties.

Surprisingly he did pay Sept's rent yesterday! With Oct around the corner, we will see how that goes. Maybe its just a misunderstanding but its obvious I need to hire a PM to take care of all this. Too stressful.
It is still imperative that you send a N4. Include a note explaining your policy of issuing a N4 every time a tenant pays even 1 minute late. Explain that you need the records in order to protect yourself in the event you are required to evict for persistent lates.
Put a little fear in this tenant and things may improve.
It is important that tenants be taught who is in control and at this point in time, unfortunately, it is your tenant.
You have not seen an end to this drama yet.
I wouldn't see the point though - extra $$ wasted for owner if hiring both pm for one off ltb and a paralegal.. paralegal should be sufficient.

OK I should have listed to Invest4Profit - so I got my Sept/Oct's rent and post dated cheques. So now I'm thinking it is a misunderstanding ~ all good? No, the November rent cheque bounced and he will not return my call nor my emails. I am not going to send him the N4. I should have listened to the xperts!!
