We are switching management companies. We have been told we need to provide 30 days notice to the current tenants. Is this correct? Does anyone have any experience with this?
 
Standard business terms and conditions usually have 30 days notice in them.

Have you checked your contract that you signed with them? Or didn't you have one?
 
Just wondering if there is any legislation that requires us to give tenants 30 days notice. Our contract with current PM is 60 days which we knew going into this.
 
I'm not following - you are aware you are supposed to provide 60 days notice and PM company wants 30 days notice and you have a concern on this?



Can you clarify or re-word?
 
Not for us in Halifax but common courtesy means that we tell them yes.

Do the tenants pay the PM company the rents as that would mean that they should definitely know to write cheques to the new PM company?
 
Is there a law in Alberta which states that tenants must be given 30 days prior notice when having a new management firm taking over? I am not aware of anything in this respect. Our current PM says we have to give current tenants 30 days prior notice to having a new PM firm and are seeking confirmation / clarification on this as this is new to us and have never heard of this before.

You TELL the tenant, hopefully with enough notice, to make the cheque out to a new firm for the next 1st of the month.

Just to clarify, there is no law requiring you give your tenants 30 days notice in Alberta. We are talking about the agreement is between the tenant and the "landlord". Most PM's are the agent for the landlord, so the PM company acts on your behalf.



30 days is just a couresty to your tenants.



Many tenants pay by pre authorized bank withdrawels (PAW) and post dated cheques. PAW are usually done 3 days prior to the first of the month.



Notice for your property manager on the contract between you as the owner and landlord, and your agent, the property manager is whatever the contract you signed states. That could be 30, 60 ,90 days or 2 years.



We have taken over buildings on the last day of the month, and we just give the tenants notice. MOST property management firms with work with the new property manager on the change over. Tenants will pay one or the other, but in the end all works out.
