Condo Board

I bought a condo in St Albert and had a sewer backup March 09, repaired by insurance, and another sewer backup July first. The sewer line as videoed and tree roots were the problem. The condo board has taken until Dec to repair the line so we were unable to repair the damage. My rentors gave notice and now I have a damaged condo that needs repair and no rentors. Should I expect conpensation from the condo board for the excessive time and neglegence of repairing the line the first time?

You could sue the board .. and you may or may not win .. you decide if this is worth your time and $8,000 (or more) in legal fees ..

Terry,

I would say it is not worth your time going for the legal battle. My suggestion is to get involved and be integrated with your condo association. Be part of the board if you have the time and run in the next GM so you will know and influence any issue, expenses and overall decision making related to the corporation.

I agree that it is probably not worth the aggravation and money to sue. Our justice system is not very good and very expensive. Sueing a Condo Corp is nearly like trying to sue the government for damages; you are depending on the honesty and caprices of the condo board. In the Western world, litigation is so tortuous that there is no longer true justice and if you can not trust somebodies word, why bother with a written contract. The only winners are lawyers... no wonder there are so many bad lawyer jokes.

However, I would write a letter to the Condoboard outlining your damage and the role the Condo Corp played in it. Don`t forget the condo board is comprised of fellow owners and the quality of the board is a reflection of the ownership. They may only meet monthly or bi-monthly and so decision times are sometimes long. Your letter may help them change their decision making process or they may reprimand the property manager who is responsible for day to day operations. Maybe the board feels guilty and tries to make up.

In the end, I suggest like in earlier posts to get involved with the condo board so that it runs the way you feel is appropriate. Get familiar with your Condo`s by-laws and the provincial condominium act. Condo-ownership has a lot of advantages but standing by the side-lines and let others do the work is definitely going to bite you.
