Lobbying for Changes to Ontario`s LandlordTentant Act

New to REIN

Question is there any lobbying REIN will or has done to the Ontario Government to make amendments to the Landlord & Tentant Act. It is truly Tentant friendly.

REIN members can, and many have contacted members of government. REIN encourages political involvement and the ability for investors to have an impact on the operating environment.
REIN isn`t a political lobbying group though.

After visiting the Board today, the people we very helpful but they even admit there are some great holes in the act.

I plan on lobbying the Ministry that it shouldnt be so tentant sided.

Does anyone know of any province where the Landlord Tentant act is more landlord friendly?
 
There are lots of people who feel the same way you do!!

If Ontario wants to continue to have private investment in rentals...there must be changes!

I had a situation that I was involved in (fortunately, not in my own property) where the tenancy was obtained through fraud. All of the information provided on the application (other than the tenant`s name) was false and the references were confederates. Rent cheques regularly bounced. The tenant was charged with Obtain Accomodation by Fraud under the Criminal Code for both this and his previous tenancy, from which he was evicted for the exact same things.

You would think that a situation like this should be a slam-dunk for the Landlord & Tenant Board to decide to terminate the lease. But instead, they took the position that the tenant obtained his tenancy because the landlord failed to do proper due diligence. There is no provision in the Residential Tenancies Act to terminate a lease based on fraud, or even failing to live up to the terms of the lease (other than paying rent). So the landlord had to proceed under one of the existing grounds for termination, in this case, non-payment.

The lesson: do a thorough check of your applicants and above all, visit the place they say they are living now.

By the way, what changes to the RTA are you advocating?

There is a lot
going on behind the scenes.

Especially when the latest polls have Mr. Hudak and the PC`s ahead of the McGuinty socialists!

It would be helpful if others joined the large movement that has started to change the RTA and reform the LTB.
 
I am currently wading through all the Divisional Court Rulings in Ontario looking for the 212 cases appealed by tenants from the Landlord & Tenant Board. My goal is to discover how many of those cases were Non Payment of rent appeals and how many were quashed. Once I have the information (I suspect it`s 100%) I will then ask MPP`s to require payment of rent arrears into the board before allowing an appeal to the Divisional Court.

I do this on my own without any help because I believe this is the most significant risk facing landlords today. The tenants who do this kind of predation do not stop and it takes up to 1 year to evict them.

It looks like this predator takes 6 months of rent... time for a standard eviction plus a review of the eviction at the board. Good thing she doesn`t appeal to divisional court. That takes another six months.

This lady who made the paper is just a standard predator.

Ontario is far from the only place where horrible tenants exist and victimize people. Make no mistake these people are psychopaths. No different from other criminals who prey on the elderly, vulnerable and naive.
