HiI`m new to this and I need some advise.I had a tenant do a midnight run on the 4th of the month after his cheque bounced.In the Lease Agreement it states the following:
ABANDONMENT 15. Should the Tenant fail to take possession of the premises at the
commencement of the term of this Agreement, or abandon the premises before the expiration of this Agreement, the Landlord may take possession without notice or demand and re-let the premises on such conditions as the Landlord may deem advisable. Without prejudice to the Landlord`s right to recover rent and utility charges which may by owing and without prejudice to any claim or claims for damages, the Tenant will be charged a re-rental fee of $ 500.00 and will also be responsible for paying the rent until the end of the Residential Tenancy Agreement term, or until a new tenant, suitable to the Landlord, is found to occupy the premises.
NON SUFFICIENT FUNDS/
LATE RENT 18. Rent will be collected on the first day of each month. If
upon collection there are insufficient funds to cover rent; the following charges will be applied:
$50 for non-sufficient funds
Plus $150 late fee
Plus $10 per day for every day rent is past due.
So can I try to certify his postdated cheques to try to recover all of these fees? What if the fees are less that the cheque is worth?
I`d love some help!!
