Mobile homes and pad rental

A friend of mine has recently purchased and moved into a mobile home near Calgary. The situation seems pretty typical. She and her boyfriend own the mobile home and pay a pad rental fee each month.

My questions:

What is there to protect her from a drastic increase in the pad rental amount?

Do the municipalities usually have rules in place to govern this sort of thing?

What kind of due dilligence should one be doing BEFORE purchasing a mobile home that will sit on a rented pad?

In my legal practice I almost never run across issues relating to mobile homes. However, there is a piece of legislation called , I believe, The Mobile Homes Sites Tenancies Act. That piece of legislation would be a good place to start in trying to get answers to your questions. You could go to the Service Alberta website ; there should be lots of information there on this issue.

Before purchasing a mobile read and fully understand the park rules.
Owners need to understand every aspect of there life is impacted by the park owner.
They are renters.
Find out about the water and sewer system.This is often the most troublesome aspect
of park life.
The very best parks to buy in are the ones with the strictest park rules. A park owner that
enforces high quality standards maintains the value of his park as well as the value of every home.
