I took possession of a house with an up and down suite ten days ago, last night I got a call from the upstairs tenant`s boss who had come down because my tenant was over come by "fumes" that came from the basement. She couldn`t breath and was unable to talk clearly, they said there was a strong sweet odor in the house and was stronger then pot (the basement tenant claims it was just pot). They called the RCMP and when they arrived 45 minutes later, the downstairs tenant had returned from wherever he went and was arrested. The RCMP couldn`t give me any information last night because it was an ongoing investigation (but if he can I talked to one officer and he said he would call me), so I don`t know FORSURE it was meth, but I would really like to get them out. Our Manitoba tenancy branch gives me the option of a 5 day notice to evict, and I was wondering if I should also call the health and safety department to have them investigate this too, what will they do if it was a meth lab? This is the first month in their tenancy so I would hope the damage won`t be too bad. But I don`t want the whole place to be shut down.

I know I should have found my own tenants, but I didn`t think that the vendors would set me up with a meth lab! Lesson number 1

I`d get in and view the place asap (if it is safe, of course). I would access the premises as I deem this to be an emergency and do so without notice. If there is illegal activity, than get them out right away. In AB, you can evict in 24
hours when there is illegal acitivity. Engage professional services and get your possession of your suite.

Follow the province tenancy act to the letter and deal with the issue immediately and fully. That`s all you can do.
The fumes coming up yesterday may not be considered emergency. Do not expose yourself to costly mistakes. In Ontario a 24 hr notice to enter can be posted on the door and the reasons to enter are also specified.

Okay I did talk to a corporal from the RCMP Thursday who went there on Tuesday night, he said it was pot that was being smoked, no meth. But I did give a 5 day eviction notice on Wednesday because of Illegal activity and causing a major disturbance. The guy was charge with a few things and sounds like he could be going "away" so the woman wouldn`t be able to pay the rent anyway. I placed an ad yesterday at noon and had three replies by four.

It sounds like the woman and kids are gone, she did ask if I was keeping the damage deposit, I told her I don`t want to and if there is no damage she will get it all back, I hope this will keep them from damaging the unit. The guy was back there on Thursday night, and the upstairs tenant called us and told us there was alot of noise, not crashing but some banging, I hope he isn`t so stupid as to cost them a damage deposit. But we did call the RCMP and told them to look into it, they called us back and said it was dark and there was no one there.
