Serve N4 or just have him sign Form N11 in this case..?

Hi,
One of my tenants wants to move out end of this month and did not pay rent on the 1[sup]st[/sup]. I have a last month rent from him but since he was supposed to give me 60 days notice (not 30) he was still supposed to pay for this month.

would you serve N4 in this case or just have him sign form N11 and let him move out a month earlier and pay one month less?

He has been a good long term tenant, I think N11 is more suitable(?)

He was a good tenant right up till he decided to move without giving 60 days notice.

I would serve him with a N4 and explain that he is responsible to give 60 days notice. Tell him he owes February rent but if you find a new tenant for the first of March you will return his last month rent deposit otherwise it will be applied to March.

The fact that he was a good tenant is irrelevant to the bank book especially since he will soon be a X tenant likely never to be seen again.

I always put business first.

Absolutely do both. The are separate and have different purpose. N4 for not paying rent on time and N11 for mutual agreement to end tenancy and move out date. Both are important and necessary.
