Similar Company Name

Hi there,

If you happen to know that a similar company name exist and active in other province or country, are you legally obligated to change your registered company name through a corporate lawyer or simply do nothing because they were incorporated in different province or country?

Any thoughts in this matter?

You have to do nothing, but of course might get sued later. So if your firm is called IBM real estate ventures or Microsoft properties or Google land corp they will probably not sit idle. You must do a NUANCE search as part of your incorporation.

Similar names are very common and most folks do not get sued. The firm suing has to prove damages and that is hard if you are in BC or AB and they operate only in ON with a similar or even same name.

I may be mistaken, but I believe type of business affects this as well. Similar name & similar (or identical) type of business... bad news blues.
