How does one handle the No Smoking Rule when Tenants continue to ignore it?
 
I am only speaking to Ablerta, however it would be grounds for eviction if part of the lease.

That`s true you can only warn a Tenant so many times.

But how would you prove it for an eviction? This becomes a matter of `he said, she said`, if it goes to court.
 
Here is an interesting recent Ontario court ruling on damages awarded because of a tenant who smoked. It was a sizable judgement awarded to the Landlord.

In some areas of the city it is very hard to find a non-smoker. I explain the No Smoking Rule to new Tenants, as they
agree to smoke outside. But the rule still has to be inforced by the Landlord just like any rule on the premises.

If it is part of your lease you can evict them..... If you do not live in the house you have to have written complaints from other tenants in the building. Including dated and timed logs of smoking activity and your tenants must agree to show up to court if need be. This is one way to show proof.
