Selling Calgary property owners are currently working/living overseas

Hi,
With the downturn, we had to find jobs out of town. One of us is in Vietnam the other is in the USA. Our real estate agent does not know how to have us sign off on the listing agreement, or respond to buy offers. Obviously, we can't fly back to list the property and wait. We want to manage the sale from overseas.

Can we do this with pdf documents notarized by local Notary publics and scanned and returned to the agent? Can we do it only by email? Are there any surprise tax implications? What's the best way to do this?

Who is a good lawyer in Calgary who can assist with this?

Nowadays document printing, signing, scanning and then sending back seems from medieval times. Your real estate agent doesn’t work with DocuSign? All you need is, preferably, a separate email address for each.

Tax implications, no, if it’s primary residence. Yes, if it’s not, and are expecting to make a profit on the property, 50% of the capital gain will be taxed.

Naturally, turning a profit on a prop that you bought let’s say in the last 10 years in or around Calgary would be nothing short of a miracle.

Just a straightforward sale of a prop, any decent lawyer could help you with that.

Only land transfer doc needs to be notarized AND a original !

Hey, Neil,

Exactly what Martin and Thomas said. My last two purchases were done here in Calgary with DocuSign. This is common practice now. If your realtor is having problems... I suggest you get a second opinion. This does not add up. I used Bill at https://www.calgarylaw.com/ twice now and he is efficient and effective.
